HB 247 moves to amend 1) Title 16 of the OCGA to repeal the penalty of battery against a person 65 years of age or older; 2) OCGA 16-5-100 to revise the definition of "exploit" to include the illegal taking of resources belonging to a disabled adult or elder person when access to the resources was obtained due to the disabled adult's or elder person's mental or physical incapacity; 3) Code Sections 30-5-4 and 45-17-8 to require public notaries to report the abuse, neglecting or exploitation of disabled adults or elder persons; 3) Code Section 31-7-12.1 to allow law enforcement agencies to conduct inspections of unlicensed personal care homes. The bill also amends the punishment of improper licensing and crimes against elder persons. |
